Release of Liability and Indemnity Agreement

1. Agreement overview
The nanny agrees to release and hold harmless Stephanie Sidwell doing business as Sea to Sky Nannies from any liability arising out of or related to their placement with families through the agency. This release applies to any claims, damages, injuries, or incidents that may occur during or after the course of their employment with the family.
2. Acknowledgment of risk
The nanny acknowledges that their work may involve risks, including but not limited to physical injury, property damage, emotional distress, or other unforeseen circumstances while caring for children and performing household tasks.
3. Release of claims
The nanny agrees to release, waive, and discharge Sea to Sky Nannies from any and all claims, demands, causes of action, or liabilities of any kind that may arise from their employment with a family, including but not limited to: personal injury (physical or psychological); breach of contract; issues arising from negligence; property damage or loss; disputes with families, parents, or household members; and any actions or omissions made during the course of their duties.
4. Indemnification
The nanny agrees to indemnify and hold harmless Sea to Sky Nannies from any claims or liabilities arising from their own negligence, misconduct, or failure to perform duties as required by the family or by law. This includes legal fees, costs, and expenses associated with any action or claim.
5. Employment conditions
The nanny agrees that Sea to Sky Nannies is acting solely as a referral agency and is not responsible for overseeing or managing the nanny’s work or personal conduct while placed with a family. It is the nanny’s responsibility to ensure their professional behavior aligns with the family’s expectations and contractual terms. The nanny is responsible for filing their own taxes.
6. Insurance
The nanny may be encouraged (but not required) to maintain personal liability insurance or other forms of protection, including workers’ compensation, health insurance, and any coverage deemed appropriate for their professional work. The nanny acknowledges that Sea to Sky Nannies does not provide such insurance.
7. Families you meet through the agency
For twelve months after Sea to Sky Nannies introduces the nanny to a family, the nanny agrees that any care provided for that family will be arranged through the agency, and that the nanny will not accept work from, or take a direct placement with, that family outside the agency. If a family asks the nanny to work with them directly, the nanny agrees to refer them to Sea to Sky Nannies.
8. Governing law
This release of liability and indemnity agreement is governed by the laws of the province of British Columbia, and any disputes shall be resolved through mediation or arbitration in accordance with the laws of that jurisdiction.
9. Entire agreement
This document constitutes the entire agreement between Sea to Sky Nannies and the nanny. No other verbal or written agreements, representations, or promises are valid unless expressly stated herein.
10. Acknowledgment of understanding
The nanny acknowledges that they have read this release and indemnity agreement, understand its contents, have had the opportunity to seek independent legal advice before signing it, and voluntarily agree to the terms set forth.
